Administrative Services

There are a number of services offered by NLPA where we can assist a defendant directly without the need of retaining counsel. These services are referred to as Administrative Services. If you're unsure if NLPA's Administrative Services is an aid that could assist you, contact our office and one of our specialized team members will provide a review and free consultation.

While not all of our Administrative Services will apply to your specific case, we have included an outline and explanation of some of the services we can provide:

Institutional Designation

The  Bureau of Prisons may house federal inmates at any facility throughout any of their locations in the United States. Many defendants willneed assistance with institutional designation to ensure that are housed near family members. If you're camp eligible, appropriate for minimum security designation or are burdened with a public safety factor, NLPA can assist. We start with collecting your own personal data and corrections classifications and will assist you in determining which specific designation you may qualify for. Your ultimate location and classification will always be determined by the Bureau of Prisons, however we can assist in providing the best case in your status change.

Interstate Transfers

Requesting transfer to an out of state facility to complete your sentencing is something that NLPA has years of experience in handling. Many factors are considered, such as whether the receiving facility has rooms available, the defendants security and that the custody level is acceptable to the prisoner. With the Interstate Compact it is possible to avoid issues such as prison overcrowding by requesting that a prisoner exchange be conducted. Within weeks after being retained, NLPA can complete the necessary paperwork and submit these documents to the receiving state for their approval. Should your request be granted, the transfer can happen quickly based on the state and facility requested to be transferred. Keep in mind that some facilities may require the prisoner to be included on a waiting list.Each state and facility varies in their process, waiting time and accommodations and with NLPA's assistance we will be able to determine the best approach for this transfer to be completed.

Intrastate Transfers

If you are a state inmate wanting to transfer to another facility within the same state, NLPA can be of assistance. Similar to the interstate transfer, NLPA will prepare the necessary written transfer requests and forward it to the appropriate Department of Corrections personnel for approval. As a same-state prisoner you will be eligible for intra-state transfers which could be more streamlined that an interstate transfer. This can be done by submitting your request through the Department of Corrections and Parole Authority and does not include the delays of submitting your paperwork out of state. Once the request has been made the appropriate authorities will notify you of their decision. Keep in mind that safety issues, crowding and other factors determine your approval.

Federal Transfers

As a federal inmate within the Bureau of Prisons, NLPA can assist you with the complex and often times significant process in effectuating a federal transfer. This is because requests are not only considered at the local level but also at the Regional and Central Office of the Bureau of Prisons located in Washington, DC. With the abundance of appeal forms that are required to be filed NLPA can assist with your federal transfer and any should you be denied, we will continue close communication and effort throughout the appeal process. Once retained, you will be assigned an NLPA case manager whose experience and education ensures for you to have a clear understanding of what to expect and what steps would occurring next. Put our expertise to work as many other inmates and their families have to assist with this type of process.

Drug Program Application (Federal)

In 1966 the United States Congress established the Narcotic Addict Rehabilitation Act (NARA) to address the challenges of drugs and alcohol addiction among inmates. This was later added upon with the establishment of RDAP or Residential Drug and Alcohol Program. This well-developed curriculum accepts qualified inmates to attend class sessions for 500 hours. Completion of this intense program can, in some cases, make an inmate eligible for up to one year of reduction in sentencing. NLPA can assist with your Federal Drug Program Application or if you have applied and been denied, we can assist in the appeal of this decision. NLPA has worked extensively with qualified inmates to apply or even those who have denied admission into this treatment. If an inmate, utilizing NLPA's Administrative Services, has exhausted all of these remedies in respect to appealing an improper denial of participation or a refusal by the Bureau of Prisons, we are able to offer advanced services to assist you in US District Court in completing request.

Medical Treatment Furlough

NLPA can assist in preparing a strong request to the Bureau of Prisons based upon your medical conditions. Pursuant to Bureau of Prisons Program Statement, the Attorney General of the United States has delegated the authority to grant furloughs under Title 18 United States Code Section 4082(c) to the Director, Bureau of Prisons (28CFR0.96)d. Title 18 USC 4082 which applies to inmates whose offenses occurred before November 1, 1987. For inmates whose offenses occurred on or after November 1, 1987 the statutory authority for furloughs is found in Title 18 USC Section 3662 of the Comprehensive Crime Control Act. The authority to approve furloughs in Bureau of Prisons institutions is delegated to the Warden or the Acting Warden. Pursuant to BOP Program Statement 5280.4 the Warden may approve a medical furlough for purposes of obtaining necessary medical, surgical, psychiatric or dental treatment not otherwise available.

Halfway House/House Arrest Placement/Work Release (State & Federal)

Federal Inmates

Since the Federal Bureau of Prisons has reduced the maximum time eligible to serve at a community treatment center, the process is no longer as simple. Previously, inmates would be able to serve their final six months of incarceration in a halfway house or work release program with relative ease. This new structuring requires the inmate the burden to pursue the structure of a post-release program which will enable the inmate to try and take advantage of other alternatives while completing their time of incarceration. With NLPA's assistance we can help the inmate and their family in structuring a program which could combine alternatives such as placement in a community treatment center, curfew parole (which normally covers the last 60 days of the inmates confinement) or the new Federal Bureau of Prison's electronic monitor surveillance program. Pursuant to the provisions of Title 18 United States Code Section 3624(c) the Bureau of Prisons is limited by statute to giving an inmate a CTC/House Arrest Placement of 6 months or 10% of his sentence whichever is less. The Bureau of Prisons is currently proposing legislation to Congress to permit the Bureau of Prisons further latitude with regard to this so that they can provide more lengthy halfway house/electronic monitoring placements to inmates who meet the appropriate qualifications. However, those modifications in the law have not yet been passed by Congress.

State Inmates

If you are interested in maximizing your time on work release, at a community treatment center or other forms of alternative community confinement as a means of reducing your term of incarceration such as house arrest, NLPA can has the professional staff and service to assist you. Although there are various programs available in each state that may help reduce your sentencing time, the burden is upon you to aggressively pursue the structuring of a post-release program. Once retained NLPA can become involved in assisting you in applying through the Department of Corrections (DOC) for all programs for which you may qualify.

Pardon/Clemency

Often times an inmate may seek the pursuit of an executive pardon or clemency from their state official. NLPA can assist you in the preparation of an application for executive clemency or pardon. As an administrative proceeding, it is not a matter that requires that you have licensed counsel to represent you and NLPA can prepare and submit the necessary Pardon or Clemency applications on your behalf.

Parole

Effectively preparing for a parole hearing can be an extremely difficult and complex matter. This is why many inmates have utilized the services of the National Legal Professional Associates in assisting them through the process. Wile you may complete all the necessary work on your own and represent yourself to the State Parole Board, you can decide to have NLPA's assistance with completing and preparing for the this hearing. NLPA can assist with items such as a pre-hearing memorandum, to be submitted to the Parole Board's office or appearing with you during your parole hearing. NLPA's expert staff will work closely with you in preparing this information while relying on your individual input and records.

Federal UNICOR Application

Federal Prison Industries, also known as UNICOR and FPI, is a wholly owned government corporation created in 1934 by statute and Executive Order that produces goods and services from the labor of inmates of the United States Federal Bureau of Prisons. FPI is restricted to selling its products and services to Federal government agencies and has no access to the commercial market. UNICOR was created in the 1930s, when the employment of prisoners was provided for in the Act of May 27, 1930, and Federal Prison Industries was formally created in 1934.

For many federal inmates, the UNICOR work program may be available. There are currently a number facilities in the UNICOR program that offer jobs to thousands of inmates nationwide. If you are interested in applying for the UNICOR program and/or being transferred to a facility that offers UNICOR (if your current facility does not offer this program) NLPA can be of assistance.

Statistical Studies

Often times, post-conviction defendants debate over information that may be been useful to them in the beginning stages of their case that they were not aware of at the time. This may include attorney records, judgment records for the convicting judge, comparable case outcomes, etc. If you are interested in researching this type of information you obviously know that there is much involved in doing so. However, NLPA can assist you in securing the necessary documentation and review the documents to determine statistical figures that could be beneficial to your future pursuits. This can also include statistical research of administrative matters. Backed by our graphics design department, NLPA can also compile all of the data into professional reports complete with charts, graphs, grids, etc. Either way, it helps to have a dedicated team behind you.
